User agreement (public offer)

This user agreement (hereinafter referred to as the "Agreement") is a public offer of the Contractor, offering to conclude an agreement for users of the site CatCloud.io (hereinafter referred to as the "Site") for the right to use the services of the Site.

Registration on the Site is an action confirming acceptance by the user of the terms of this Agreement in full (acceptance of the offer).

1. DEFINITIONS

In this Agreement, unless the context otherwise requires, the following terms are used in the following meanings:

"SITE" is a resource on the Internet at CatCloud.io, the content of which belongs to the Contractor and is controlled by the Contractor.

"USER" - an individual who has the necessary civil legal capacity, has reached the age of 18 (eighteen) years, accepts the terms of the Agreement, has his own e-mail address, access to which is at his disposal, to which he can receive a confirmation letter registration on the Site and subscribing in the manner prescribed by the terms of this offer.

"RECURRENT PAYMENTS" - regular payments, of which the user confirms only the first one, and the rest are made automatically.

"PERSONAL OFFICE" - means an account created by the User by entering personal data for the registration process on the Site for the purpose of authorized access and use of the Services on the Site.

2. GENERAL PROVISIONS

2.1. Full and unconditional acceptance (acceptance) of the terms of this offer is the registration of the user on the Site, making a payment in the amount of 100% of the prepayment of the subscription cost according to the tariff and receipt of the corresponding funds on the account of the Contractor.

2.2. This public offer is an official document and is published on the website, which is a public service for all Internet users and operates in compliance with the current legislation of the Russian Federation.

2.3. This Agreement applies for an indefinite period during which the user accesses the services of the Site.

2.4. The Contractor reserves the right to make changes to the text of this agreement, sections of the Site, without special notice to the user by publishing a new edition, which comes into force from the moment it is posted on the site.

2.5. The Contractor reserves the right to make changes to the functionality of the Site at its discretion, change the terms of subscription, make any other changes to the functionality of the site without prior notice to the User.

2.6. The Contractor is not responsible for the consequences associated with the fact that the user has not read the rules set forth in this Agreement.

3. PERSONAL ACCOUNT

3.1. To start using the Services, the user must register for an Account on the site by entering their username, age, current email address, phone number and password.

3.2. The user must not disclose his registration data to anyone, allow anyone to use it, transfer his account to third parties, or allow any other third party to use his account. The user is responsible for the security of his Account and registration data.

3.3. The User's personal account will register all his funds, payments and types of subscriptions.

3.4. The User agrees that the Contractor uses and processes the User's personal data in accordance with the current legislation of the Russian Federation and the Contractor's Privacy Policy.

3.5. The user agrees that after completing the registration procedure on the Site, the Contractor will send letters and messages to the user's email address, including those of an advertising nature. At the same time, the Contractor undertakes not to transfer the email address, as well as any other information about the user to third parties.

3.5. The Contractor reserves the right to suspend and / or terminate the User Account in accordance with the terms of this Agreement.

4. INTERACTION WITH OTHER SITE MEMBERS

4.1. The User is solely responsible for his interactions with other Members. The Contractor does not request information about the past of its Participants and does not verify the accuracy of the specified information. The performer makes no guarantees regarding the behavior of the participants or their compatibility with current or future participants.

4.2. In no case will the Contractor be liable for any direct, indirect, general or special damage, compensatory, and / or accidental, received by the user or other persons as a result of using the site, including but not limited to: bodily injury, stress and / or other damage received by you as a result of communication or meetings with other registered users of the site or people with whom the user encounters on the site.

4.3. The user agrees to take all possible precautions when communicating with other members of the site, especially in those cases when he decides to meet with them in real life. The user should be aware that the Contractor does not give any explicit or implied guarantees regarding compatibility with users of this site. The user should not provide information of a financial nature to other members of the site (for example, information about a credit or bank card). Most of the portal members that the user can interact with after registration are fictional characters. Any interaction with them can be imaginary.

4.4. The site may ask you to rate other users' photos or ask other users to rate your photos. The site may send you notifications that other users have entered your profile (by mail or through the site) if a user has rated your photo or entered your profile through the Site. The site uses an algorithm to automatically detect attention or activity. The site can automatically translate your name and the name of your city into other languages.

4.5. The site is not responsible for the actions listed in this paragraph. If the user does not agree with them in whole or in part, PLEASE LEAVE THE SITE IMMEDIATELY.

5. USER CONTENT

5.1 The User is solely responsible for the Content that he publishes or demonstrates on the Site or transmits to other Participants. The User is prohibited from posting or transmitting to other Members any defamatory, inaccurate, offensive, obscene, vulgar, aggressive materials, materials of a sexual, threatening, harassing, racially discriminatory nature or illegal materials, or any other materials that infringe or violate the rights of any other party ( including, without exception, intellectual property rights, privacy and publicity rights).

5.2. The User is prohibited from providing inaccurate, false or untrue information about himself to the Contractor or any other Member, or misleading about his identity. If the information provided to the Contractor or another Participant subsequently becomes inaccurate, false or untrue, the user is obliged to immediately inform the Contractor of such a change. The user declares and warrants that all information provided during registration is accurate and correct, and the user is obliged to immediately change any information that subsequently becomes inaccurate, misleading or false.

5.3. The Participant, as the owner of the information posted on his own personal page, is aware that, with the exception of the cases established by these Terms, applicable law, the Site administration does not take part in the formation and use of the content and control of other users' access to your personal page. By posting information on a personal page, including his personal data, the user understands and agrees that this information may be available to other Internet users, taking into account the peculiarities of the architecture and functionality of the Site.

5.4. By posting legally owned information on the Site, the user grants other Members a non-exclusive right to use it solely within the framework of the functionality provided by the Site, by viewing, reproducing (including copying) and other rights solely for the purpose of personal non-commercial use, unless such use causes or may harm the legally protected interests of the copyright holder.

5.5. The User also grants the Contractor a non-exclusive right to use, free of charge, the content posted on the Site and legally owned by him in order to provide the Contractor with the functioning of the Site to the extent determined by the functionality and architecture of the Site, and display content in the Site's promotional materials, including within the images of the Site interface , including by bringing such promotional materials to the public. This non-exclusive right is granted for the period of posting content on the Site and extends its effect on the territory of countries around the world. The expiration of the term for posting content on the Site and / or the term of validity of a non-exclusive right does not entail the need to withdraw from circulation the Site's promotional materials with the display of content (including their removal from the Internet). The Contractor has the right to transfer the rights specified in this paragraph to third parties.

5.6. In addition to his own information, the user is not entitled to upload or publish on the Site content of other sites, databases and other results of intellectual activity in the absence of the explicit consent of the copyright holder to such actions.

5.7. Any use of the Site or information of other Members or other Internet users, except as permitted in these Terms or in the case of the express consent of the copyright holder to such use, without the prior written permission of the copyright holder, is strictly prohibited.

5.8. Below is a partial list of the types of content that are illegal or prohibited for posting on the Site. We reserve the right to investigate and take appropriate legal action in our sole discretion against any person who violates this provision, including removing offending messages from the Site and terminating the participation of such violators. This also applies to content that:

• is clearly offensive to the online community, such as content that encourages racism, bigotry, hatred or physical violence of any kind against any group or individual;
• insults or promotes insulting a specific person;
• includes the transmission of “promotional emails”, “happiness emails” or unsolicited bulk mailings or “spam”;
• disseminates information that is known to be false, untrue, or provokes illegal actions or behavior of an offensive, threatening, obscene, dishonorable or defamatory nature;
• promotes illegal or unauthorized copying of another person's work, for example, provides pirated computer programs or links to them, information on how to bypass copy-protected devices, or provides pirated images, audio or video files, or links to pirated images, audio or video files; contains pages with restricted access or password, or hidden pages or images (not associated with another accessible page);
• provides material that shows exploitation of minors in a sexual or violent manner, or requests personal information about minors;
• provides educational information about illegal activities such as making or buying illegal weapons, violating the privacy of others, or providing or creating computer viruses;
• requests passwords or personal data for commercial or illegal purposes from other users;
• engages in commercial activities and / or sales without our prior written consent, such as contests, sweepstakes, barter, advertising and pyramid schemes; has indications of pornographic or erotic content, including content that demonstrates intercourse, naked genitals, etc.

5.9. Your use of the Site, including the posting of any information on the Site, must comply with all applicable laws.

5.10. The User must not include phone numbers, addresses, surnames, URLs or email addresses in their Member profile.

5.11. To protect our Members from advertisements or other unsolicited information, we reserve the right to limit the number of emails that any Member can send to another Member within 24 hours, to an amount that we deem rational in our sole discretion.

5.12. All information that a user enters into his Member profile must be accurate, current and complete.

6. RESPONSIBILITY

6.1. The Contractor undertakes to fulfill its obligations in accordance with the terms of this Agreement published on this Site.

6.2. The Contractor shall not be liable in the event of improper provision of the service resulting from inaccuracy, insufficiency or untimely information and / or documents provided by the user, as well as due to other violations of the terms of this offer by the user.

6.3. The Contractor is not responsible for the discrepancy between the provided service and the user's expectations and / or his subjective assessment.

6.4. The Contractor makes every effort to ensure the accuracy and regular update of the information presented on the Site, while retaining the right to change at any time and without prior notice any materials posted on the site. At the same time, the Contractor cannot guarantee the correctness, accuracy and comprehensiveness of the information provided, therefore, disclaims any responsibility for:

• inaccurate, incomplete and insufficient nature of any materials posted on the Site;
• any damage resulting from changes in information by third parties who have unauthorized access to the Site;
• any damage resulting from the user's access to the Site and / or the impossibility of such, including direct damage and loss of profits, whatever the reasons that caused this damage, as well as direct and / or indirect consequences;
• for losses incurred by the user as a result of incorrect indication of his personal data.

6.5. In other cases of non-fulfillment or improper fulfillment of their obligations, the Parties are liable in accordance with the current legislation of the Russian Federation.

6.6. The Contractor will make every effort to ensure the uninterrupted and correct operation of the site, however, during some periods the site may be inaccessible or work with errors, be incompatible with the technical equipment and software of the user, its server may contain errors or viruses, other malicious programs of any type and variety - due to unforeseen circumstances that occurred through no fault of the Contractor, who in this case does not bear any responsibility for any damage, losses and losses that the user may incur as a result of using the site.
